Terms of Service - CleanUp AI: Storage Cleaner

Please read these Terms of Service ("Terms") carefully before using the CleanUp AI: Storage Cleaner mobile application ("App") operated by DocGPT.AI ("we," "us," or "our").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

CleanUp AI: Storage Cleaner is a mobile application designed to help you:

  • Identify and remove duplicate photos
  • Find and manage similar photos
  • Organize screenshots and screen recordings
  • Compress videos to save storage space
  • Find and merge duplicate contacts
  • Identify contacts with missing information
  • Create local backups of your contacts

All processing occurs locally on your device. We do not upload, store, or transmit your photos, videos, or contacts to any external servers.

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

4. User Account

The App does not require you to create an account. All functionality is available without registration. If subscriptions are managed through your Apple ID, Apple handles all account-related matters.

5. Subscriptions and Payments

5.1 Subscription Plans

The App may offer subscription plans that provide access to premium features. Available plans may include:

  • Weekly Subscription: Billed weekly
  • Yearly Subscription: Billed annually

5.2 Free Trial

We may offer a free trial period for certain subscription plans. If you do not cancel before the free trial ends, you will be automatically charged for the subscription at the price displayed at the time of purchase.

5.3 Payment Processing

All payments are processed through Apple's App Store. By subscribing, you agree to Apple's payment terms. We do not have access to your payment information.

5.4 Auto-Renewal

Important: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

5.5 Managing Subscriptions

You can manage and cancel your subscription at any time through your Apple ID account settings:

  1. Open the Settings app on your iPhone
  2. Tap your name at the top
  3. Tap "Subscriptions"
  4. Select "CleanUp AI: Storage Cleaner"
  5. Tap "Cancel Subscription"

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until then.

5.6 Refunds

All purchases are final. Refund requests must be submitted directly to Apple through their standard refund process. We cannot process refunds directly as all transactions are handled by Apple.

6. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple devices that you own or control, solely for your personal, non-commercial use.

7. Restrictions

You agree not to:

  • Copy, modify, or distribute the App
  • Reverse engineer, decompile, or disassemble the App
  • Rent, lease, lend, sell, or sublicense the App
  • Use the App for any unlawful purpose
  • Remove any copyright or proprietary notices from the App
  • Attempt to gain unauthorized access to any part of the App
  • Use the App in any way that could damage, disable, or impair the App

8. Device Permissions

8.1 Photo Library Access

The App requires access to your Photo Library to identify duplicates, similar photos, and videos for compression. This access is used solely for the stated purposes and all processing occurs on your device.

8.2 Contacts Access

The App requires access to your Contacts to find duplicates and incomplete contacts. This access is used solely for the stated purposes and all processing occurs on your device.

8.3 Revoking Permissions

You can revoke these permissions at any time through iOS Settings. However, certain features may not function without the required permissions.

9. Intellectual Property

The App and its original content, features, and functionality are owned by DocGPT.AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. User Content

You retain full ownership of your photos, videos, and contacts. The App processes this content locally on your device and does not claim any ownership or rights to your content.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF CONTENT

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DOCGPT.AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Any damages resulting from your use or inability to use the App
  • Any unauthorized access to or alteration of your data
  • Any third-party content or conduct

Our total liability shall not exceed the amount you paid us in the twelve (12) months prior to the claim, or $100 USD, whichever is greater.

13. Indemnification

You agree to defend, indemnify, and hold harmless DocGPT.AI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

14. Data Handling

Your privacy is important to us. Please review our Privacy Policy for information about how we handle your data. Key points:

  • All data processing occurs locally on your device
  • We do not collect, upload, or store your personal data
  • Your photos and contacts never leave your device

15. Third-Party Services

The App uses Apple's StoreKit for subscription management. Your use of Apple services is subject to Apple's terms and conditions. We are not responsible for Apple's services or policies.

16. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

17. Changes to Terms

We may revise these Terms at any time. Material changes will be reflected in the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

18. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately. You may also terminate by deleting the App from your device.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Ukraine.

20. Dispute Resolution

21. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DocGPT.AI regarding the App and supersede all prior agreements and understandings.
