Terms of Service - Photo Sweeper AI Pro

Please read these Terms of Service ("Terms") carefully before using the Photo Sweeper AI Pro application ("App") operated by DocGPT.AI ("we," "us," or "our").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Photo Sweeper AI Pro is an application for macOS and iOS designed to help you:

Identify and remove duplicate photos from your Photo Library
Find similar photos and group them for easy review
Compare photo metadata to choose which copies to keep
Scan folders on your Mac for duplicate images
Free up storage space by removing unwanted duplicates

All processing occurs locally on your device. We do not upload, store, or transmit your photos to any external servers.

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

4. User Account

The App does not require you to create an account. All functionality is available without registration. Subscriptions are managed through your Apple ID, and Apple handles all account-related matters.

5. Subscriptions and Payments

5.1 Subscription Plans

The App offers the following plans to access premium features:

Monthly Subscription: Billed monthly at $3.99 USD
Yearly Subscription: Billed annually at $14.99 USD (includes a 3-day free trial)
Lifetime Purchase: One-time payment of $29.99 USD for permanent access

5.2 Free Trial

The yearly subscription includes a 3-day free trial. If you do not cancel before the free trial ends, you will be automatically charged for the subscription at the price displayed at the time of purchase.

5.3 Payment Processing

All payments are processed through Apple's App Store. By subscribing or purchasing, you agree to Apple's payment terms. We do not have access to your payment information.

5.4 Auto-Renewal

Important: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

5.5 Managing Subscriptions

You can manage and cancel your subscription at any time through your Apple ID account settings:

iPhone/iPad: Settings > Your Name > Subscriptions
Mac: App Store > Account > Subscriptions

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until then.

5.6 Refunds

All purchases are final. Refund requests must be submitted directly to Apple through their standard refund process at reportaproblem.apple.com. We cannot process refunds directly as all transactions are handled by Apple.

6. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple devices that you own or control, solely for your personal, non-commercial use.

7. Restrictions

You agree not to:

Copy, modify, or distribute the App
Reverse engineer, decompile, or disassemble the App
Rent, lease, lend, sell, or sublicense the App
Use the App for any unlawful purpose
Remove any copyright or proprietary notices from the App
Attempt to gain unauthorized access to any part of the App

8. Device Permissions

8.1 Photo Library Permission

Why we need it: To scan your photos for duplicates and similar images.

What we do: Analyze photos locally to identify duplicate groups.

What we don't do: Upload, share, or transmit your photos anywhere.

8.2 Folder Access (macOS)

Why we need it: To scan folders you choose for duplicate photos.

What we do: Read image files in selected folders for comparison.

What we don't do: Access folders you have not explicitly selected.

8.3 Revoking Permissions

You can revoke permissions at any time through System Settings (macOS) or Settings (iOS). Certain features may not function without the required permissions.

9. Photo Deletion

Important: When you choose to delete duplicate photos through the App, those photos are moved to the Recently Deleted album in your Photo Library (where they remain for approximately 30 days before permanent deletion) or moved to Trash on macOS for folder-based scans. We recommend reviewing your selections carefully before confirming deletion. We are not responsible for any unintended photo deletions.

10. Intellectual Property

The App and its original content, features, and functionality are owned by DocGPT.AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

11. User Content

You retain full ownership of your photos. The App processes your content locally on your device and does not claim any ownership or rights to your content.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Duplicate detection is based on algorithmic comparison and may not identify all duplicates or may occasionally flag non-duplicate photos.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DOCGPT.AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PHOTOS, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

Our total liability shall not exceed the amount you paid us in the twelve (12) months prior to the claim, or $100 USD, whichever is greater.

14. Data Handling

Your privacy is important to us. Please review our Privacy Policy for information about how we handle your data. All data processing occurs locally on your device.

15. Third-Party Services

The App uses Apple's StoreKit for subscription and purchase management. Your use of Apple services is subject to Apple's terms and conditions.

16. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App at any time with or without notice. We shall not be liable for any modification, suspension, or discontinuation of the App.

17. Changes to Terms

We may revise these Terms at any time. Material changes will be reflected in the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms.

18. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. You may also terminate by deleting the App from your device.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.

20. Dispute Resolution

21. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DocGPT.AI regarding the App.
